PNGkitch Terms of Service

1. About these terms
These terms govern your use of PNGkitch (including the web and desktop versions, the "Software"), provided by kyoko kuboe, operating as pinkitch ("we"). By using the Software you agree to these terms.
2. License
Subject to these terms, we grant you a non-exclusive, non-transferable right to use the Software. The Free version is available at no charge. Pro features are licensed through a purchase made via Polar Software, Inc. (Merchant of Record).
3. Free / Pro and license keys
Free users may try Pro features; images exported while using a Pro feature carry a watermark. Pro purchasers receive a license key. License keys may not be shared, resold, or published. (Seat counts and device limits are still being determined.)
4. Prohibited conduct
You may not reverse engineer the Software (except where permitted by law), redistribute it, or use it for any unlawful purpose or in violation of public order.
5. Intellectual property
Rights in the Software and its logos, characters, and documentation belong to us or our licensors. Rights in the images and annotation data you create with the Software belong to you.
6. Updates, changes, and discontinuation
We may add, change, or discontinue features without prior notice. Files you have already saved are standard PNGs and remain viewable as images even if the service ends.
7. Disclaimer
The Software is provided "as is". To the extent permitted by law, we are not liable for damages arising from use of, or inability to use, the Software.
8. Sales and refunds
Sales, payments, and refunds for Pro features are processed under the Buyer Terms and refund conditions of Polar Software, Inc., our Merchant of Record. See the Legal Notice under the Act on Specified Commercial Transactions for details.
9. Governing law and jurisdiction
These terms are governed by the laws of Japan. (The competent court is still to be specified.)
